Terms of Use

These Terms of Use govern your access to and use of MOZAIC Core. By creating an account, starting a trial, or subscribing, you agree to be bound by them on behalf of your organisation.

1. Definitions

In these Terms, "MOZAIC Core", "we", "us" and "our" refer to MOZAIC FRANQUICIAS Y FORMACION SL, a company registered in Málaga, Spain (NIF B06996706). "Platform" means the MOZAIC Core software-as-a-service application, including the back-office dashboard and any public agent or organisation microsites generated through it. "Organisation", "you" and "your" refer to the professional services firm that creates an account and its authorised users. "Client Data" means any data your Organisation submits to, or collects through, the Platform relating to your own clients, leads, or buyers.

2. Platform Access and Eligibility

MOZAIC Core is available to professional services firms via a 14-day free trial. By starting a trial or subscription, you confirm that you are at least 18 years old and authorised to enter into this agreement on behalf of your Organisation. Access is provided on a per-Organisation, multi-user basis under the plan you select. We reserve the right to suspend or terminate access for breach of these Terms.

3. Acceptable Use

You agree not to:

  • Submit false or misleading information
  • Attempt to access another organisation's data or bypass tenant isolation controls
  • Use the platform to process data for purposes other than those disclosed to your own clients
  • Reverse-engineer, copy, resell, or redistribute any part of the platform
  • Use the platform to send unsolicited communications (spam) or in violation of applicable law
  • Attempt to circumvent rate limits, security controls, or usage quotas

4. Free Trial

New organisations receive a 14-day free trial with full platform access. A valid payment method is required at the start of the trial. Your subscription begins automatically at the plan rate selected at signup if you do not cancel before the trial ends. No charge is made during the trial period.

5. Subscription Plans, Billing and Payment

Monthly subscriptions are billed on a recurring monthly basis and renew automatically until cancelled. You may cancel at any time via the billing portal; cancellation takes effect at the end of the current billing period.

Annual subscriptions are charged as a single upfront payment equivalent to 10 months at the selected monthly rate (a saving of approximately 17%). The full annual amount is charged at the end of the 14-day free trial and covers 12 months from the charge date.

All payments are processed by Stripe, Inc. We do not store your full card details. Prices are shown exclusive of applicable VAT, which is added at checkout where required.

We may change subscription prices from time to time. Any price change will not affect your current billing period and will take effect no earlier than your next renewal, with at least 30 days' notice.

6. Cancellation and Refunds

Trial

You may cancel at any time during the 14-day free trial at no charge. Cancellation must be completed before the trial period ends to avoid being charged.

Monthly

Monthly subscribers may cancel at any time. Cancellation takes effect at the end of the current billing period, and access continues until then. No refunds are issued for the current or any prior billing period.

Annual

Annual subscribers may cancel at any time to prevent automatic renewal at the end of the 12-month period. No refunds are issued for the current or any prior annual period, in part or in full. Following cancellation, access to the platform continues until the end of the paid annual period.

7. Data Retention and Deletion

Following cancellation or expiry of your subscription, your Organisation's account and Client Data are retained for 90 days, during which you may reactivate your subscription to restore full access. After this 90-day period, your account and all associated Client Data are permanently deleted from our production systems and cannot be recovered. You may request earlier deletion of your data at any time by contacting us, subject to any data we are required to retain by law (for example, billing records). Backups containing your data are retained separately in line with our backup retention schedule and are not immediately purged, but are not used to restore deleted accounts outside the 90-day window described above.

8. AI Features and AI-Generated Content

MOZAIC Core's public chatbot and the authenticated in-platform help assistant are AI systems powered by a third-party AI provider (Anthropic). Some organisations also enable an AI chat widget on their own public microsite, powered by that organisation's own third-party AI provider account (Anthropic or OpenAI) rather than ours. When you interact with any of these, you are interacting with an AI system, not a human — this is disclosed directly in the chat interface itself. AI-generated responses may be inaccurate or incomplete and do not constitute professional, legal, or financial advice; you should independently verify anything important before relying on it. Separately, MOZAIC Core includes AI tools your Organisation may use to generate social media captions, follow-up messages, and other content for your own publication. All such AI-generated content requires human review and approval before publication, and you are solely responsible for the accuracy and appropriateness of any content you choose to publish through the platform.

9. Data Protection and Responsibility

Organisations using MOZAIC Core are the data controllers for their own Client Data. MOZAIC FRANQUICIAS Y FORMACION SL acts as a data processor and processes Client Data only on your instructions, as described in our Privacy Policy. You are responsible for ensuring your use of the platform, and any data you submit to it, complies with GDPR and any other applicable data protection law in your jurisdiction, including obtaining any consents needed from your own clients. Where you use platform features that connect to third-party AI providers under a Bring-Your-Own-Key model, data you submit for processing may be sent to that provider, and you are responsible for that provider's own terms and data handling practices.

10. Intellectual Property

MOZAIC Core, including its software, design, and branding, is owned by MOZAIC FRANQUICIAS Y FORMACION SL and its licensors. Nothing in these Terms transfers ownership of the platform to you. You retain all rights to your own Client Data and any content you upload or create using the platform. You grant us a limited licence to host, process, and display that content solely for the purpose of providing the platform to you, including generating your public agent or organisation microsite.

11. Service Availability and Support

MOZAIC Core is provided on a best-efforts basis. We do not guarantee uninterrupted availability. We will provide reasonable notice of planned maintenance where possible. We are not liable for any loss arising from temporary unavailability of the platform.

12. Limitation of Liability

To the maximum extent permitted by law, MOZAIC FRANQUICIAS Y FORMACION SL is not liable for any indirect, incidental, or consequential loss arising from your use of MOZAIC Core or inability to use it. Our total liability arising from or related to these Terms will not exceed the total fees paid by your Organisation in the 12 months preceding the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.

13. Indemnification

You agree to indemnify and hold MOZAIC FRANQUICIAS Y FORMACION SL harmless from any claims, losses, or damages arising from your breach of these Terms, your Client Data, or your use of the platform in violation of applicable law.

14. Term and Termination

These Terms apply for as long as you maintain an active trial or subscription. We may suspend or terminate your access immediately if you materially breach these Terms, including non-payment, or if required to do so by law. On termination, Section 7 (Data Retention and Deletion) governs what happens to your Client Data.

15. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified to active subscribers by email or in-platform notice at least 14 days before taking effect. Continued use of the platform after changes take effect constitutes acceptance of the updated Terms. The date at the top of this page reflects when it was last revised.

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of Spain. Any disputes arising from or relating to these Terms or your use of MOZAIC Core shall be subject to the exclusive jurisdiction of the courts of Málaga, Spain.
